When Ohio Senator JD Vance was briefing the press earlier today, he was asked about East Palestine residents being required to sign indemnity waivers, releasing Norfolk Southern Railway from legal liability, as a requirement of having their water/air tests conducted on their property.
Senator Vance said he talked to a resident about it, then reviewed the contract and confirmed the indemnity demand. Vance then immediately called Norfolk Southern Railroad officials and asked them about it. Everyone is asking about drinking water; but how about showering and bathing? Chemicals are absorbed into your skin. I would not want to use the water at all; nor would I want to have my pets walking on the soil! Just breathing the air, to me, is a real risk.
All these residents should be relocated ASAP.

To answer your question, does anyone really believe the contingency waivers were “accidentally” presented”, for any of us who have negotiated and administered large to very large contracts with large corporations or governments, many terms and conditions are “boiler plate” in essence to general contracts, some of those T’s&C’s are negotiable, or the provider might try to unethically slip it in once it is brought to their attention by saying, “oh that. That doesn’t apply to you”. But given the context of such a contract given to these residents, it would be odd that such a generic type contract would even exist with a railroad company to begin with. After all, how many times would a RR need to provide any other Party a “contract” in a situation of a potential liability claim to begin with? It is not odd then, that an indemnity or hold harmless clause exists in such legalese, but I advocate that in this case the clause had to of been intentional.

I see soem news articles that say, “we tested for A, B, C, and X, Y, Z etc.” naming a bunch of chemicals they tested for – “all clean.” They have tested for things that are not there – for example, all the Vinyl Chloride got burned up and it ended up as dioxin which is horribly toxic. Some news articles have mentioned there would be dioxin in the soil and water. BUT – when I see test results, I don’t see that anyone is testing for dioxin. That is one of the most toxic substances in the world, and somebody better be testing for it. Convenient that the train company has hired a contractor to test, and they are not testing for dioxin. Apparently EPA isn’t testing for dioxin either. That needs to be checked, and then you will find something, I think.
I read legal waivers all day, and I would say it’s very common to have the hold harmless language in any standard contract. I think this news article is manipulating readers by not actually posting the contract portions to be reviewed (IE the facts) so it can help determine if the contract used was some idiot employee using a standard (template) type agreement with hold harmless language, or if it was a customized contract drawn up with this language for nefarious reasons.
We need to blame someone to get justice/accountability. Blaming an interchangeable politician is an inconvenience for the Puppet Masters AND a huge relief for them. Look deeper.

From what I saw of the waiver, the “on” specification for the “date of signing” was nebulously worded and could be inferred as the start date of the waiver, with no future limit. For it to be as Norfolk’s legal weasels implied, it should have read ” … on and limited to, the date of signing … “.
